These Terms and Conditions ("Terms") constitute a legally binding agreement between the user ("Customer" or "You") and AirGuru regarding the use of our website and services. By accepting these Terms, you acknowledge that you are bound by them, any additional terms applicable to our services, our Privacy Policy, and our Fees structure. It is recommended that you carefully read and understand these Terms, the Privacy Policy, and Our Pricing & Fees before engaging with AirGuru for any of our services. 1. Use and Nature of Our Services

1.1 Use of Our Services

By accepting these Terms and using our services, you affirm that you are a natural person over the age of legal majority in your country of residence, capable of entering into legally binding agreements under applicable law. You are authorized to enter into these Terms and any service-specific terms on your own behalf and, if applicable, on behalf of other passengers.

1.2 Nature of Our Services

AirGuru provides services to help air passengers manage the impact of flight disruption. These services include facilitating the processing of claims on behalf of passengers before airlines, enforcing air passengers' rights, and claiming compensation for delayed or canceled flights. It is important to note that AirGuru is not a law firm, and we do not act as lawyers on your behalf or provide legal services directly. However, we may engage contract lawyers or attorneys for the purpose of providing our services.

1.3 Definitions

  • Customer/User/You: Refers to the user of AirGuru's website and services.
  • AirGuru: Refers to the service provider, AirGuru.
  • Services: Refers to the compensation services provided by AirGuru, including claim processing, legal support, and related activities.

1.4 Eligibility

The eligibility for compensation is an estimation and does not guarantee compensations. AirGuru facilitates compensations based on various laws and regulations but cannot guarantee the success of every claim.

2. Compensation Service

2.1 Agreement

By using AirGuru's compensation service, you either record your electronic signature on our virtual signing tool or acknowledge your acceptance of these Terms and the Privacy Policy. This allows AirGuru to file claims on your behalf. By accepting these terms, you agree not to pursue the claim by any other means, directly or through third parties, and no legal dispute is pending or expected between you and the airline on the same matter.

2.2 Existing Claims

If you have an existing claim with third parties or the airline directly, you must cancel these before proceeding with AirGuru's compensation service. Failure to do so may result in the non-provision of compensation services.

2.3 Right to Refuse Service

AirGuru reserves the right to refuse compensation services or may request further information/documents before providing compensation service.

2.4 Third-Party Pursuit

Once you have submitted our forms and initiated our compensation service, you cannot use other third parties to file a claim unless you first withdraw our service.

2.5 Withdrawal of Service

If you wish to withdraw from our service, it must be done within 7 days of entering into a compensation agreement with us. Withdrawal is only possible if the airline has not accepted our claim. To withdraw, send an email to contact@airguru.app.

2.6 Compensation Received Directly

If you receive compensation directly from the airline rather than through AirGuru, you must share our fees as outlined in our fees and pricing section.

3. Legal Actions

3.1 Legal Action Pricing

In case legal actions are required, the pricing is 50% of the compensation received, different from our standard 20% fee.

3.2 Conditions for Legal Action

Legal actions may be taken in cases where the airline fails to provide compensation within a reasonable time or ceases communication, and we anticipate non-compliance.

4. Withdrawal/Termination of Service

4.1 Withdrawal Conditions

Withdrawal is possible if the airline has not accepted our claim and must be done within 7 days of entering into a compensation agreement. To withdraw, send an email to contact@airguru.app.

4.2 AirGuru's Right to Withdraw

AirGuru reserves the right to withdraw from compensation service in case of unforeseen obstacles such as insolvency, court closure, pandemic, low flight compensation value, etc. No fee will apply.

4.3 Termination for Breach

AirGuru reserves the right to terminate service if the user has breached their obligations, provided incorrect information, or engaged in fraudulent activities. AirGuru also reserves the right to claim losses in case of a breach of contract or fraud.

5. Data Privacy

By using our services, you acknowledge our data practices as outlined in our Privacy Policy. For more details, please refer to our Privacy Policy.

6. Disclaimer of Warranties and Limitation of Liabilities

6.1 No Warranties

AirGuru provides its services "as is" without any warranty, either expressed or implied.

6.2 Limitation of Liabilities

AirGuru shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of our services.

7. Right to Modify Agreement

AirGuru reserves the right to update or modify this Agreement. Changes will be effective upon posting on our website, and it is your responsibility to review this policy periodically.

8. Language Consistency

In case of any inconsistency between the English version of these Terms and any other language, the English version shall prevail.

9. Governing Laws

These Terms are governed by the laws of India, and any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.
